This “Privacy Policy” describes the privacy practices of FreshPlanet Inc. and our subsidiaries and affiliates (collectively, “FreshPlanet”, “we”, “us”, or “our”) in connection with the SongPop Classic ® mobile application our games and games services (the “App”). This Privacy Policy describes how we collect, use, disclose and otherwise process personal information in connection with the App, and explains the rights and choices available to individuals with respect to their information.

We provide important information for individuals located in the European Union here.

Personal information we collect

Information you give us
Personal information that you may provide through the App or otherwise communicate with us, including by connecting to our App using your Facebook account, includes:

● Contact information, such as your first name, last name, email address, and phone number and similar identifiers
● Profile information, such as your Facebook username, user ID, profile picture, cover photo, and networks in which you participate (e.g., school, workplace); username you establish with us; biographical information that you provide; and information about your interests and preferences
● Demographic details, such as your age range, language, country, and gender
● Other information that you may choose to authorize us to obtain from Facebook, such as your birthday, friends list, and email address
● Feedback and correspondence, such as information you provide when you report a problem with the App, receive customer support, or otherwise correspond with us
● Transaction information, such as details about purchases you make through the App, and information you provide when you enter into one of our contests or other promotions
● Usage information, such as information about how you use the App and interact with us, including playlists, songs liked, your opponents and scores
● Geolocation information, including information about your location that you provide through the App or elsewhere
● Marketing information, such your preferences for receiving marketing communications and details about how you engage with marketing communications
● Other Personal Information you submit to us through the App, such as information you provide when you use chat features and any other interactive features of the App, and information associated with any information you submit to us through the App
● Audio, Electronic, Visual or other Information such as any photograph you provide as part of your user profile.

Information we collect from other users
We collect information that other users of the App may provide about you, such as the fact that you may be a Facebook friend of another user. Users are able to see a list of their Facebook friends who also use the App.

Referrals
Existing users of our App may have the opportunity to refer friends or other contacts to us. If you are an existing user, you may only submit a referral if you have permission to provide the referral’s contact information to us.

Information automatically collected
When you access our App, we, our service providers, and our business partners may automatically collect Personal Information about you, your mobile device, and activity within our App. The information that may be collected automatically includes your mobile device operating system type and version number, manufacturer and model, device identifier, screen resolution, IP address, cell network-based location information, access times and how long you spent accessing content within the App, navigation paths between the screens of the App, and information about your activity on a screen.

How we use your personal information

To provide our App
If you create an account within the App or otherwise use our App, we use your Personal Information to:

● operate, maintain, administer and improve the App
● create and manage your user profile within the App
● enable you to login to the App using third-party authentication providers, such as Facebook
● facilitate social features of our app
● customize and personalize your user experience
● manage and communicate with you regarding your account with us
● process and manage purchases and registrations you make through the App
● provide support and maintenance for the App
● respond to your service-related requests, questions, feedback, and complaints

If you connect to the App via Facebook, we automatically complete your profile with the name and profile photo that we obtained from Facebook. You may change the information contained within your user profile via the settings screen of the App.

To communicate with you
If you request information from us or participate in our contests or promotions, we may send you FreshPlanet-related marketing communications as permitted by law. You will have the ability to opt out of such communications.

To display advertisements within the App
We work with advertising partners to display advertisements within the App to users who do not have VIP status. These advertisements may be targeted based on your activity within the App or elsewhere online.

With your consent
We will request your consent to use your Personal Information where required by law. If we request your consent to use your Personal Information, you have the right to withdraw your consent anytime.

To create anonymous data for analytics
We may create anonymous data from your Personal Information and aggregate it with that of other individuals.

For compliance, fraud prevention and safety
We use your personal information as necessary to enforce the terms and conditions of the Service and to protect our rights and privacy.

How we share your personal information

Affiliates
We may disclose your Personal Information to our subsidiaries and corporate affiliates.

Users of the App/Visitors to the App
Your user profile within the App is visible to other users of the App.

Service Providers
We may employ third party companies to administer and provide the App on our behalf. These third parties may use your Personal Information only as directed by the Company.

Professional advisors
We may disclose your Personal Information to professional advisors, where necessary for the professional services that they render to us.

Business Transfers
FreshPlanet may sell, transfer or share some or all of its business or assets, including your Personal Information, in connection with a business transaction.

We may share your Personal Information with our advertisers to facilitate providing you relevant advertisements.

Your choices

Connecting via Facebook
If you choose to connect to the App via your Facebook account, you may choose to limit the information that we may obtain from Facebook about you.

App privacy settings and location data
We make available certain Privacy settings within the App. You also have the choice whether to allow us to access your location data.

Targeted online advertising
Some of the business partners that collect information about users’ activities in our App may be members of organizations or programs that provide choices to individuals regarding targeted advertising. App users may opt out.

Access, Update, Correct or Delete Your Information
All App users may review, update, correct or delete the Personal Information in their registration profile by logging into the App. You may contact us at privacy@freshplanet.com to submit a request.

Choosing not to share your personal information
If you do not provide required Personal Information, we may not be able to provide you with the App.

Security

The security of your Personal Information is important to us. We take reasonable measures designed to protect the Personal Information we collect.

Children

We encourage parents and guardians to teach their children about privacy. We consider a user to be a child if they are under the age of 13.

No personal information should be submitted to Gameloft by users under the minimum legal age.

Sensitive personal information

We ask that you not send us any sensitive Personal Information on the App. We do not deliberately collect such sensitive Personal Information through the App.

International transfer

FreshPlanet may have service providers in other countries. Your personal information may be transferred to the United States or other locations where privacy laws may not be as protective.

Cross-Border Data Transfer
Whenever we transfer your personal information out of the EEA, the transfer will be based on your consent.

Other websites & services

The App may contain links to other websites. We do not exercise control over third party websites and services.
